A charge of practising without a current practising certificate (APC) was established against an experienced dentist (the Dentist) who practised for seven months without an APC.
The Tribunal imposed an order of censure, fined the Dentist $2,000 and ordered him to pay costs of $12,000. The Tribunal expressed strong disapproval for the circumstances that arose, particularly as the Dentist continued to practise without a current APC not withstanding multiply communications from the Dental Council and a specific warning. The Tribunal accepted that the Dentist's personal circumstances were a mitigating factor. The Dentist's name, locality and personal circumstances were suppressed by the Tribunal.
